Legal regime applicable to<\/h2>\n\n<p class=\"wp-block-paragraph\"><br \/>APPART-HOTEL 76 is designated as the brand owned by SASU APPARTEL registered at the RCS OF DIEPPE whose registered office is ZI Louis Delaporte Green Zone 76370 Rouxmesnil-bouteilles, below the operating company. As such it offers a hosting service in units of accommodation-furnished.<br \/><br \/>The present general conditions of sale apply to all bookings made within our facility (&#034;the appartel&#034;), subject to the status of the &#034;residences&#034; or &#034; tourist homes &#034;, composed of accommodation units furnished for temporary stays and accessories from a few days to a few months. These accommodation units are furnished are in no way intended to constitute principal residences or second homes, so it is forbidden to establish his residence in places that either continuous or discontinuous. The client undertakes to maintain, for the duration of his stay in a residence main and effective. It is forbidden to practice any trade, business, craft or profession. This contract may be regarded as a contract owner in the sense that the provision of services characteristics of this type of contract, are not insured ; the proposed services are not included in the price and only available as accessory, the client can enjoy complete independence.<br \/><br \/>Booking a stay requires the prior acceptance of the present general terms and conditions of sale, regardless of the sales channel, which supersede all other previous terms and conditions or any terms and conditions of purchase. The Customer acknowledges having had communication, prior to the booking, to you in a legible and understandable manner, these general conditions of sale and all information listed in article L. 221-5 of the consumer Code. He declares to have read these general Conditions of sale and to have accepted previously, and if the sale is made online, by checking the box provided for<br \/>for this purpose before the implementation of the booking process, as well as the general terms and conditions of use of the website &#034;www.appartel,en&#034;. Unless proved otherwise, the data recorded in the computer system APPARTEL constitute proof of all transactions concluded with the Customer. The customer is informed that his \/ her IP address is recorded at the time of booking.<br \/><br \/>It is recalled that the photos presented on the booking sites are not contractual.<br \/><br \/>Rules of procedure are available in all of our homes ,either by way of display in self-service in a workbook dedicated to it. Any malfunction<br \/>or degradation must be declared on arrival, failing which the Client is presumed to have taken his unit of accommodation, furniture and equipment in good condition.<\/p>\n\n<h2 class=\"wp-block-heading\">2. Booking<\/h2>\n\n<p class=\"wp-block-paragraph\"><br \/>Every booking is personal and can not be transferred to a third party, whether free of charge or for a valuable consideration. Given the nature of the services provided, the booking made by the Client does not benefit from the right of withdrawal<br \/>in accordance with the provisions of article L221-28 12\u00b0 of the consumer Code. The contract is concluded definitively from the time of booking, unless possibilities of cancellation under these terms.<\/p>\n\n<h3 class=\"wp-block-heading\"><br \/>2.1 normal Booking<\/h3>\n\n<p class=\"wp-block-paragraph\"><br \/>The booking of an accommodation unit in a residence APPARTEL is only valid after written confirmation of the reservation by APPARTEL subject to the terms and conditions of sale previously accepted. In addition, the booking needs to be considered to be firm, to be <strong>warranty<\/strong> either by:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>providing a credit card number (card networks Carte Bleue, Visa, Eurocard\/Mastercard, American Express are accepted) in progress<br \/>validity on the length of stay, possibly renewed, which may be charged by APPARTEL for the total amount of the stay, including for<br \/>cover the cancellation fee within the conditions and limits laid down in article 3 of these general terms and conditions of sale. See also supra section 6<br \/>for the warranty.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><br \/><br \/><strong>Only the owner of the credit card can make the payment-in-residence. The same card must be presented before the delivery of keys and identity papers.<\/strong><\/p>\n\n<h3 class=\"wp-block-heading\"><br \/>2.2 Reservation is Non-Cancellable, Non-Refundable, non-Exchangeable\/editable so-called &#034; NANR &#034;<\/h3>\n\n<p class=\"wp-block-paragraph\"><br \/>Given the preferential rate, no cancellation, no exchange or change of date or person, or refund can only be made to a reservation so-called NANR. The provisions of article 3 below are, therefore, not applicable. No refund is not carried out in case of no show (No Show). Regardless of the reasons for the cancellation or the date on which the reservation is cancelled, a compensation equal to the total amount of the stay, including any fringe benefits<br \/>booked and invoiced, shall be retained. In the case of a booking under the terms NANR, a total payment for the stay will be made on the booking confirmation. The booking will then be considered as binding only after actual receipt and the total of the stay. <strong>The credit card that was used to make the booking must be presented upon arrival before the delivery of keys and identity papers.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">\u00a0<\/p>\n\n<h2 class=\"wp-block-heading\">3. Cancellation or change of booking<\/h2>\n\n<h3 class=\"wp-block-heading\"><br \/>3.1 Prior to arrival<\/h3>\n\n<h4 class=\"wp-block-heading\">3.1.1 Conditions of the cancellation<\/h4>\n\n<ul class=\"wp-block-list\">\n<li>Stay of 1 to 7 nights : Without charge for a cancellation 7 days before arrival.<br \/>beyond that, the total amount of the stay will be charged ;<\/li>\n\n<li>Stay of 8 to 27 nights: Without charge for a cancellation 7 days before arrival.<br \/>Beyond a total amount of the stay will be charged ;<\/li>\n\n<li>Stay of 28 nights or more: Free of charge up to J-15, noon (GMT+1h). Beyond,<br \/>total amount of the stay will be charged (in the limit of a month).<br \/>These terms are applicable only to bookings referenced to the <strong>2.1.<\/strong><\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\"><br \/>3.1.2 Conditions of partial cancellation<\/h4>\n\n<p class=\"wp-block-paragraph\"><br \/>Is treated as a partial cancellation, any change of length of stay, date, type of accommodation, the number of occupants or place of stay as originally booked and confirmed.<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Stay of 1 to 4 nights : Free of charge until 7 days before midday (GMT+1h). Beyond that, the amount of the stay that is not consumed will be charged ;<\/li>\n\n<li>Stay of 5 to 27 nights : Free of charge up to J-7, noon (GMT+1h). Beyond that, the amount of the stay that is not consumed will be charged ;<\/li>\n\n<li>Stay of 28 nights or more: Free of charge up to J-15, noon (GMT+1h). Beyond that, the amount of the stay that is not consumed will be charged (in the limit of a month).<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><br \/>These terms are applicable only to bookings referenced to the <strong>2.1<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>To be taken into account, any cancellation (partial or total) must be notified :<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>with APPARTEL when the booking has been made directly<\/strong><\/li>\n\n<li><strong>with APPARTEL, either directly from the Residence by e-mail or via the online booking system if the booking has<br \/>been made via this channel &#034;www.appartel.fr&#034; in the MY ACCOUNT section. \u2013 with the service provider requested during the reservation of the unit<br \/>accommodation.<\/strong><\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><br \/>3.2 during the stay :<\/h3>\n\n<h4 class=\"wp-block-heading\"><br \/>3.2.1 early Departure<\/h4>\n\n<p class=\"wp-block-paragraph\">For all stays, early departure will be charged the full amount of the original reservation.<\/p>\n\n<ul class=\"wp-block-list\">\n<li>APPARTEL attracts the attention of the Customer wishing to reduce the length of stay that the tariff conditions from which he has benefited, and will be updated on the rise, and this, from the 1st night.<\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\"><br \/>3.2.2 Extension :<\/h4>\n\n<p class=\"wp-block-paragraph\">From the day of notification, the fee for the additional nights will be updated on the basis of the price in force at the time of the extension, this extension can trigger retroactive discount. This extension is no obligation of maintaining in the same unit of accommodation and is subject to availability on the overall duration of the stay. If your stay exceeds 28 nights, the accommodation agreement shall be signed in accordance with the provisions of clause 4.2 below..<\/p>\n\n<h2 class=\"wp-block-heading\">Arrival<\/h2>\n\n<p class=\"wp-block-paragraph\">The accommodation units are available from 16 hours (local time), an early check-in and remain subject to availability and at a surcharge.<\/p>\n\n<h3 class=\"wp-block-heading\">4.1 late Arrival<\/h3>\n\n<p class=\"wp-block-paragraph\">In case of arrival outside opening hours, the amount stated in the conditions of the reservation will be charged on the day of arrival.<\/p>\n\n<h3 class=\"wp-block-heading\">4.2 Procedure of arrival for the whole stay<\/h3>\n\n<p class=\"wp-block-paragraph\">For any stay and as collateral, a credit card number (valid on the duration of stay) must be handed in on the day of arrival, before the delivery of keys. The Customer will also be required to present the credit card used to make the reservation, as well as the original of his identity. The regulation of the accommodation is made in full <strong>on the day of arrival<\/strong>before the delivery of keys. It may be requested from the customer to his arrival, a deposit fee of 300 euros to cover<br \/>damage to equipment or other disturbances and nuisances caused during the stay in accordance with the provisions of article<\/p>\n\n<h4 class=\"wp-block-heading\">4.3.1 to the exclusion of its amount.<\/h4>\n\n<p class=\"wp-block-paragraph\">In accordance with the provisions of the Code of entry and residence of foreigners and right of asylum will be asked to any customer of a foreign nationality, including, for nationals of the European Union, at the time of his arrival, to complete an individual record of police who may already be pre-filled by APPARTEL and completed a proof of identity. In order to verify the nationality of the client and the need to fill out such a form, <strong>a piece of valid id must be presented on arrival.<\/strong><\/p>\n\n<h3 class=\"wp-block-heading\">4.3 Stay of 28 nights and more<\/h3>\n\n<h4 class=\"wp-block-heading\">4.3.1 security Deposit<\/h4>\n\n<p class=\"wp-block-paragraph\">A deposit will be required for stays of 28 nights or more, on the day of arrival, before the delivery of keys. This security deposit will be charged upon arrival with the price of 1 month and can be made by credit card or bank transfer. The amount of the deposit corresponds to a 1 month stay, excluding service charges. This deposit can be used as payment for the stay and accrued unpaid, in case of damage, voluntary or involuntary, for the costs of cleaning, replacement of missing objects discovered during the departure of the client and, more generally, for proper execution of the contract of accommodation. The credit card will be debited the corresponding amount. See supra section 6 regarding the warranty. The warranty may also be used by APPARTEL in the event of a cancellation fee, non-partial or total settlement of amounts due to the company operating under the provision of accommodation and\/or optional benefits, any costs of refurbishment in the accommodation or the common areas or flight in the residence.<\/p>\n\n<h4 class=\"wp-block-heading\">4.3.2 hosting Contract<\/h4>\n\n<p class=\"wp-block-paragraph\">For stays of 28 nights or more, a hosting contract will be concluded in addition to between the residence and the Customer at the time of his arrival. The Customer must provide the documents specified below, in the absence of which the stay will take place.<\/p>\n\n<h4 class=\"wp-block-heading\">4.3.3 Documents to be submitted<\/h4>\n\n<p class=\"wp-block-paragraph\">Original of the identity card or passport ;<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Last 3 pay slips ;<\/li>\n\n<li>a current proof of residence.<\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\">4.3.4 State of play<\/h4>\n\n<p class=\"wp-block-paragraph\">An inventory will be drawn up at the entrance and at the exit of the accommodation unit between APPARTEL and the Client.<\/p>\n\n<h2 class=\"wp-block-heading\">5. Stay in our Homes - Starting<\/h2>\n\n<h3 class=\"wp-block-heading\">5.1 Occupancy<\/h3>\n\n<p class=\"wp-block-paragraph\">The booking of the accommodation has been performed for a number of people pre-determined, the change in the number of occupants will be treated as a partial cancellation and giving rise to the application of the provisions relating to the modification of the intended stay supra in section 3.1.2 and penalties related.<br \/>The accommodation is free of charge for a child under the age of two (2) years, housed in the unit of accommodation of his parents. It must be mentioned at time of booking, the provision of a cot and baby sets are offered within the limit of availability.<\/p>\n\n<h3 class=\"wp-block-heading\">5.2 Rules of procedure<\/h3>\n\n<p class=\"wp-block-paragraph\">The Customer agrees to comply with the internal rules, which is available in each accommodation unit, in the lobby, booklet displaying all of the rates and services APPARTEL reserves the right to enter the accommodation to perform the cleaning services, as well as to monitor the status and safety conditions of the accommodation. In the event of non-compliance by the Customer of its obligations hereunder as well as the internal rules of the residence, APPARTEL reserves the right to interrupt their stay.<\/p>\n\n<p class=\"wp-block-paragraph\">The entire residence is NON-SMOKING.<br \/>We do not accept animals.<\/p>\n\n<h3 class=\"wp-block-heading\">5.3 Transfer<\/h3>\n\n<p class=\"wp-block-paragraph\">In the event of the occurrence of an exceptional event, making the taking of possession of the premises cannot, APPARTEL may either propose a transfer, to all or any part of the booked stay, in another accommodation unit, offering similar services, any additional costs related to the transfer and remain in the charge of APPARTEL.<\/p>\n\n<h3 class=\"wp-block-heading\">5.4 Good use<\/h3>\n\n<p class=\"wp-block-paragraph\">The accommodation is made available in a good state of maintenance, The Customer undertakes to make it as such at the end of the stay. Use of the leased premises and facilities peacefully and in a reasonable manner, in accordance with articles 1728 and 1729 of the civil code. The Client must report to reception upon its entry into the premises (if applicable, as of the opening of the receipt in case of late arrival), all abnormalities or objects degraded.<\/p>\n\n<h3 class=\"wp-block-heading\">5.5 Departure<\/h3>\n\n<p class=\"wp-block-paragraph\">The accommodation must be vacated before 10: 00 (local time), a late check-out remain possible, subject to availability and at a surcharge. The state of cleanliness will be the subject of a control by APPARTEL, it being specified that the part kitchenette shall in all cases be cleaned by the Customer. As a result, all findings on the lack of cleanliness and any missing items or damage to property and personal property will be invoiced after the start.<\/p>\n\n<h2 class=\"wp-block-heading\">6. Price and Terms of payment<\/h2>\n\n<h3 class=\"wp-block-heading\">6.1 Rates<\/h3>\n\n<p class=\"wp-block-paragraph\">The prices are flexible and variable according to different criteria and the customization of services and including the date of booking, the start date of the holiday, its duration, the typology of the accommodation unit, the additional services (breakfast, laundry, parking,...). The tax is in addition to the amount per night and per person, the amount of the tax amounts 0.70\u20ac \/person\/ night. Service charge an amount of \u20ac 19 are payable on the arrival of the travelers. Application fees are likely<\/p>\n\n<p class=\"wp-block-paragraph\">to be requested for a stay of over a month. The prices are quoted and payable in euros. They are VAT included, per accommodation, per night for dates and length of stay selected. The room price includes water and, for stays of less than 28 days, the electrical energy. For stays greater than or equal to 28 days or more, the electric power will be charged in addition to the price. In the case of consumption unreasonable electricity and water, APPARTEL reserves the right to charge the extra cost to the Client.<br \/>The optional services are not included in the price.<br \/>In addition to the housing, it is made available various services such as the supply of linen (bed sheet, towel). These services will be charged in addition to the price of the stay, according to the rates in force on the date of the order. The payment is made in cash at the time of the order of the service. APPARTEL may change its prices at any time. In the case where the arrival takes place after the 20th of the month, the 1st settlement will cover the end of the current month and next calendar month.<br \/>The other payments are to be dealt with before the 5th of every calendar month, as of the current month. The deposit paid on booking (see above, 2.1),will be deducted from the amount of the stay.<\/p>\n\n<h3 class=\"wp-block-heading\">6.3 Warranty<\/h3>\n\n<p class=\"wp-block-paragraph\">A credit card number is valid during the stay and at least 15 days after the date of departure, you will be asked to the booking in order to secure the stay. The costs and benefits of a cancellation or no show will be charged to this card. This guarantee may be used by APPARTEL in the event of non-payment by the Customer of the outstanding amounts owed under the stay consumed including ancillary services, but also the possible damages caused in the apartment or in general within the Residence. The credit card given may be charged after the departure at the height of the estimate of the restoration of the site.<\/p>\n\n<h2 class=\"wp-block-heading\">7. Minors<\/h2>\n\n<p class=\"wp-block-paragraph\">Accommodation units at residences APPARTEL can not accommodate children under the age of 18 years and not accompanied by their legal representatives.<br \/>Therefore, APPARTEL reserves the right to deny access to a unit of accommodation that would have been reserved in ignorance of this rule. It may be performed in the immediate cancellation of the stay, the cancellation of a booking if APPARTEL discovers that the accommodation unit is intended for reception of unaccompanied minors. In the same conditions, APPARTEL may terminate at any time a residence if it is found that the accommodation unit is in reality occupied by a minor under 18 years of age unaccompanied by his legal representatives.<\/p>\n\n<h2 class=\"wp-block-heading\">8. Insurance \u2013 Liability<\/h2>\n\n<p class=\"wp-block-paragraph\">APPARTEL specifies that regardless of the duration of the stay, its liability will not be liable for :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the damage sustained by the vehicles parked on the parking outside or in the basement ;<\/li>\n\n<li>the damage to the third party ;<\/li>\n\n<li>the flight, the degradation or loss of personal effects in the accommodation units, including in the lockers and common premises,<br \/>car parks and any other dependencies or annexes to the residence ;<br \/>The present general conditions of sale are subject to the status of residences with services or tourism, the provisions of articles 1952 and following of the civil code, relating to hoteliers, are not applicable. Pets are not allowed within the facility or within units of accommodation.<br \/>You must take certain precautions to avoid any inconvenience and, in particular, that the doors and windows are properly closed. The entrance door should be locked, and you should check after using the key or badge, it does not open.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">9. Protection of personal data<\/h2>\n\n<p class=\"wp-block-paragraph\">The privacy policy of APPARTEL is available :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>on our website at the following address www.appartel.fr;<\/li>\n\n<li>in all of our residence, either by way of display in self-service in a workbook dedicated to it.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">10. Internet Access<\/h2>\n\n<p class=\"wp-block-paragraph\">The Internet connection is reserved for a personal use, non-commercial, and in a reasonable manner, in compliance with the legislation in force and of the intellectual and artistic property. The user is responsible for the proper use of the service, and is committed to ensuring Appartel against any action or claim brought by a third party because of his actions, including on the Internet. Access to the service is reserved to individuals major update of their financial obligations vis-\u00e0-vis Appartel, and<br \/>equipped with free Wi-fi and\/or Ethernet jack. Appartel disclaims any and all liability in the event of non-operation of the user equipment or incompatible with the service of access to the Internet.<br \/>Access to the Internet shall in no manner be used for purposes of reproduction, representation, making available or communication to the public of works or objects protected by a copyright or a related right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the owners of the rights provided for in books I and II of the code of the literary, artistic and industrial. Downloading illegally is a criminal offense liable to a penalty of three years imprisonment and a fine of\u20ac 300,000 for individuals, fine multiplied by 5 for the corporations.<\/p>\n\n<h2 class=\"wp-block-heading\">11. Your request should contain enough elements to be dealt with quickly as your postal address, email and telephone, as well as the full name and address of the residence APPARTEL in which you have stayed, a concise statement of the facts.<\/p>\n\n<h2 class=\"wp-block-heading\">12. Appartel \u2013 Appart-hotel 76<\/h2>\n\n<p class=\"wp-block-paragraph\">SASU French law, with capital of 1000 euros, registered with the RCS of DIEPPE, whose head office is located in ROUXMESNIL-BOTTLES(76370) ZI LOUIS DELAPORTE GREEN ZONE<\/p>\n\n<h2 class=\"wp-block-heading\">13. Intellectual property<\/h2>\n\n<p class=\"wp-block-paragraph\">APPARTEL remains the owner of all the intellectual property rights to studies, drawings, models, prototype, etc made in view of the provision of the services to the customer.
